Terms & Conditions — Benson Fechter for Congress (PA-12)

Effective date: September 12, 2025

These Terms & Conditions (“Terms”) govern your access to and use of the website and online services provided by Benson Fechter for Congress (the “Campaign,” “we,” “us,” or “our”). By using this site or interacting with the Campaign online or offline, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the site.

1) Using our site

You may use the site only for lawful, personal, non-commercial purposes related to learning about or supporting the Campaign. You agree not to:

  • Break the law or infringe others’ rights;

  • Interfere with site operation or security, attempt to probe or scan systems, or introduce malware;

  • Scrape, harvest, or collect data without permission;

  • Use automated means (bots, crawlers) without our prior written consent;

  • Misrepresent your identity or affiliation with the Campaign.

We may suspend or terminate access at any time for any reason, including suspected violations of these Terms.

2) User content

If you submit content (e.g., messages, comments, testimonials, images), you represent you have the right to do so and grant the Campaign a worldwide, royalty-free, perpetual license to use, reproduce, display, adapt, and distribute that content in any media for campaign purposes. Do not submit unlawful, defamatory, harassing, hateful, or invasive content, or anything that contains personal information about others without consent. We may remove content at our discretion.

3) Intellectual property

All site content—text, graphics, logos, photos, videos, design, and code—is owned by the Campaign or our licensors and protected by law. Except as allowed by fair use, you may not copy, modify, distribute, or create derivative works without prior written permission.

4) Donations and finance compliance

Donations are processed by third-party payment processors. By donating, you agree to their terms and any platform fees.

Federal law requires us to collect certain information (name, address, occupation, employer) and to publicly report donors whose aggregate contributions exceed $200 in an election cycle to the Federal Election Commission (FEC). Contributions are not tax-deductible.

By making a contribution, you affirm that:

  • You are a U.S. citizen or lawfully admitted permanent resident;

  • You are at least 18 years old;

  • This contribution is made from your own funds, not provided by another person or entity to be contributed by you;

  • This contribution is not made from the treasury funds of a corporation, labor organization, or national bank;

  • You are not a federal government contractor;

  • You are making this contribution with your own personal credit/debit card and not with a corporate or business card, and the contribution will not be reimbursed by another person or entity.

We may refuse, limit, or refund a contribution to comply with law or our policies. Except for proven error or as required by law, contributions are final. To request a correction or refund of a mistaken or unauthorized transaction, contact us promptly at fechterbenson@gmail.com or (412) 660-0266.

Recurring contributions

If you authorize recurring contributions, you may cancel at any time before the next charge by using the link provided in your receipt (if available) or by contacting us. Changes may take one billing cycle to process.

5) SMS, calls, and email

If you provide a phone number, you consent to receive campaign calls and texts, including via autodialer or prerecorded messages. Message frequency varies; message & data rates may apply; consent is not a condition of any purchase or donation. Text STOP to end or HELP for help. Delivery is not guaranteed.

If you provide an email, you may receive campaign emails. You can unsubscribe via the link in any message.

6) Third-party services and links

We use third parties for donations, events, analytics, advertising, maps, video hosting, and other features. Their terms and privacy policies govern your use of their services. We are not responsible for third-party content, availability, or practices.

7) Cookies and analytics

We use cookies and similar technologies to operate the site, measure performance, and improve our outreach. Settings are described in our Privacy Policy.

8) DMCA policy (copyright complaints)

If you believe your copyrighted work has been used on this site without authorization, send a written notice including: (1) identification of the work, (2) the specific URL of the allegedly infringing material, (3) your contact information, (4) a statement of good-faith belief that the use is not authorized, (5) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act, and (6) your physical or electronic signature. 9) Disclaimers

The site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that defects will be corrected.

10) Limitation of liability

To the maximum extent permitted by law, the Campaign and its officers, employees, volunteers, agents, and vendors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, data, goodwill, or other intangible losses, arising out of or related to your use of the site or these Terms, even if advised of the possibility of such damages. Our total liability for any claim is limited to the greater of $50 or the amount you paid to us for the service giving rise to the claim (excluding donations).

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.

11) Indemnification

You agree to indemnify and hold harmless the Campaign and its officers, employees, volunteers, agents, and vendors from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the site, your content, or your violation of these Terms or applicable law.

12) Dispute resolution; governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law rules.

Before filing any formal claim, you agree to first contact us to try to resolve the issue informally. If we cannot resolve it within 30 days, either party may bring an individual claim in a court of competent jurisdiction in Allegheny County, Pennsylvania. To the extent permitted by law, you and the Campaign waive the right to a jury trial and agree that any claims will be brought only in your or our individual capacity, not as a plaintiff or class member in any class or representative action.

13) Changes to these Terms

We may update these Terms from time to time. The “Effective date” shows the latest revision. Changes take effect when posted. Your continued use of the site after changes are posted constitutes acceptance.
